Trust Administration

A trust is a helpful estate planning tool because it can reduce or eliminate court involvement in the administration of a decedent’s estate. Accordingly, a trustee has significant autonomy to carry out the terms of the trust. Nevertheless, there are procedures that a trustee must follow in every trust administration. The trustee must file documents, post notices, resolve disputes, and make distributions. For some trustees, this can be a challenging task. A trustee that fails to uphold his or her fiduciary duty can be personally liable for the mistakes or omissions that result in losses for the trust. Our office has the knowledge and experience to help trustees avoid the pitfalls of a trust administration.
