Trust Administration

A trust is a helpful estate planning tool because it can reduce or eliminate court involvement in the administration of a decedent’s estate. Accordingly, a trustee has significant autonomy to carry out the terms of the trust. Nevertheless, there are procedures that a trustee must follow in every trust administration. The trustee must file documents, post notices, resolve disputes, and make distributions. For some trustees, this can be a challenging task. A trustee that fails to uphold his or her fiduciary duty can be personally liable for the mistakes or omissions that result in losses for the trust.
